Subject: Infringement of Registered Community Design No.: 002056978-0001 (ski training machines, PRO SKI - SIMULATOR) and Community Trade Mark No.: 009612631 (PRO SKI) and Copyrights in copyright works owned by DAMJAN KLAMPFER S.P.
We, the undersigned, KETNER, Legal Consultancy, Representation and Protection, Ltd., are fully authorized to act on behalf of DAMJAN KLAMPFER S.P with regards to your infringement of his:
1. Registered Community Design No.: 002056978-0001 (ski training machines, PRO SKI - SIMULATOR);
2. Community Trade Mark No.: 009612631 (PRO SKI) and
3. Copyrights.
DAMJAN KLAMPFER S.P. is the owner of the PRO SKI -SIMULATOR, ski training machine respectively a ski trainer that provides the best ski carving simulation possible without actually being on the ski slope, registered 13/06/2012 as Community Design Number 002056978-0001 (hereafter CDR). Copy of the CDR Certificate of Registration is the attachment 1 of this letter. On the basis of the CDR DAMJAN KLAMPFER S.P. has the exclusive right for the outward appearance of the PRO SKI - SIMULATOR ski training machine or a part of it in the European Union as a whole. DAMJAN KLAMPFER S.P. is the owner of the PRO SKI Community Trade Mark No.:
009612631 (hereafter CTM), registered in the class 28 of the Nice Classification, among others for Gymnastic and sporting articles what PRO SKI - SIMULATOR ski training machine certainly is. Certified Copy of the Registration Certificate from the CTM-ONLINE is the attachment 2 of this letter. A CTM is valid in the European Union as a whole, including Belgium and Netherlands. On the basis of the CTM DAMJAN KLAMPFER S.P. has the exclusive right to use the CTM and also to prevent third parties to use, without his consent, the same or similar mark for identical or similar goods as those protected by the CTM.
DAMJAN KLAMPFER is the holder of domain name www.ski-simulator.com and the owner of the copyright works presented on the web site www.ski-simulator.com, including all photographs and videos.
DAMJAN KLAMPFER S.P. is the sole owner and is the marketer and the seller of the well-known PRO SKI - SIMULATOR protected by the Community Trade Mark rights, Community Design Rights and Copyrights. Please be aware that DAMJAN KLAMFER S.P. has invested a lot to the protection of his intellectual property with this regards and has the intention to protect his intellectual property rights against infringement. DAMJAN KLAMPFER S.P. has already actively pursued the violation of his intellectual property rights against unauthorized manufactures, distributors, retailers and resellers.
DAMJAN KLAMPFER S.P. has the exclusive right to prevent you to use his copyright works, to prevent you to use the outward appearance of his CDR and to prevent you to use his CTM.
